Notificación de la Administración Judicial
On October 30, 2012, K.E.L. Title Insurance Group, Inc. ("KELTIG") was ordered into receivership for purposes of rehabilitation by the Second Judicial Circuit Court in Leon County, Florida ("Court"). The Florida Department of Financial Services is the court appointed Receiver of KELTIG. The company consented to the receivership.
Información General
KELTIG, a Florida corporation licensed in 2007, was headquartered in Orlando, Florida. The company wrote title insurance policies in Florida only. KELTIG has written in approximately 14,000 title insurance policies in Florida. KELTIG is no longer writing new insurance coverage, except for the issuance of policies for which the closing on real property occurred on or before October 12, 2012. The company’s existing policies are not cancelled by the rehabilitation order and will continue in the ordinary course of business.
The Receiver closed KELTIG’s office on December 18, 2012. For information regarding a pending claim or to file a new claim, see the Claims Information section.
On June 4, 2014, The Florida Office of Insurance Regulation approved the assessment of all Title Insurance companies domiciled in Florida for the amount sufficient to pay known claims, loss adjustment expenses and the cost of administration of the estate for the balance of 2014. Assessments may be performed on an annual basis after that and will cover Florida claims and administrative costs. For more information on the assessment, click aquí. Invoices were mailed June 9, 2014 and the payment deadline for the assessed carriers is September 4, 2014.
I am an agent who has written policies with KELTIG. What should I do?
The Receiver will be contacting you in the near future to verify all collected premium has been submitted to KELTIG. We will also be working with you to collect your unused inventory of policy jackets. Agents should complete an inventory of their current jackets to make sure all are accounted for.
Will KELTIG policyholders receive a written notice from KELTIG or the Receiver about the status of their policy?
El Administrador Judicial aún está en las primeras etapas de evaluación de la situación de la compañía. Si el estado de las pólizas de títulos previamente emitidas cambiara, los titulares de pólizas recibirán algún tipo de notificación de parte del Administrador Judicial.
Assessment Information (Florida Only)
Florida policies will remain in full force and effect during the rehabilitation of K.E.L. Title. The Receiver will calculate the amount of funds needed to pay all Florida claims and administrative expenses of this estate for one year. The information will be provided to the Office of Insurance Regulation (OIR) which will assess title insurance companies writing in Florida. The assessed amount will include the amount sufficient to pay known claims, loss adjustment expenses and the cost of administration of the estate for the balance of 2014. Assessments will be performed on an annual basis after that and will cover Florida claims and administrative costs for a one year period of time. Click here to see a copy of the Court ordered Notice and Invoice. The assessment applies to all Title insurers doing business in Florida as is applied on a market share basis. Payment is due within ninety (90) days after the date of the assessment order. Assessed companies may surcharge new policyholders a three dollar ($3.00) surcharge on each title policy issued to recoup funds. The OIR assessment of title companies required assessments to be paid by a date 90 days following the date of OIR's order or September 4, 2014.
