Información General
​On December 12, 2019, Windhaven Insurance Company (“WIC”) was ordered into receivership for purposes of rehabilitation by the Second Judicial Circuit Court in Leon County, Florida. The Florida Department of Financial Services is the court appointed Receiver of WIC.

Subsequently, effective on January 6, 2020, Windhaven Insurance Company was ordered into receivership for purposes of liquidation by the Court.

WIC was a property and casualty insurance company located in Miami, Florida. WIC was licensed in Florida in 2005 as a domestic insurer to write Private Passenger Auto Liability and Private Passenger Auto Physical Damage lines of business and commenced business in 2006. The company wrote non-standard private passenger insurance coverage. WIC had approximately 73,000 active policies as of November 30, 2019.

In accordance with the Liquidation Order the insurance policies issued by Windhaven Insurance Company are cancelled effective 12:01 a.m. on February 5, 2020.

On September 30, 2020 the mailing of approximately 55,000 Proof Of Claim forms via the U.S. Postal Service commenced.

The deadline for filing a Proof Of Claim is January 6, 2021.

​The Windhaven Insurance Company's accounts at the Bank of America are closed effective March 25, 2020.  Please do not attempt to negotiate any uncashed checks as they will be returned.

Yo soy el titular de póliza/asegurado y me deben primas no devengadas (reembolsos de primas). ¿Me pagarán?

FIGA has been activated and will pay covered unearned premium claims to Windhaven policyholders after the Department completes its processing of the policy records and sends the unearned premium records to FIGA.  A $100 per policy statutory deductible will be applied to policy refunds and will be deducted from the amount paid.

¿Qué sucede si mi reembolso es menor de $100?

Can I file a proof of claim form in the WIC estate after the filing deadline? Will it be considered late-filed?

​Yes, you may file a proof of claim. However, any form postmarked after January 6, 2021 will be processed as late-filed.

¿Por qué recibí un formulario de prueba de reclamación?

If you have received a proof of claim form, you have been identified as a potential claimant in the estate of WIC.  Receiving a proof of claim form does not mean that you do have a claim in the WIC estate, only that you were listed in the company records and could potentially have a claim.  Potential claimants can include loss claimants, policyholders, general creditors, agents, claims vendors etc.

Do I need to submit a proof of claim form to the Department in order to have the guaranty association make payments on my pending WIC claim?

​No. The guaranty association has access to the company claim files and will review your claim to determine if it is a covered claim on which payments may be due. If you are not certain that your claim is covered by the guaranty association and/or you wish to make a claim directly against the WIC receivership estate, you must submit a proof of claim form to the Department.

Do I need to submit a proof of claim form to the Department in order to have my Return Premium claim processed?

No. Unearned premiums are covered by the Florida Insurance Guaranty Association.  Unearned premium refunds for amounts over $100 have been mailed on all policies impacted by the liquidation.  There is a statutory deductible of $100 applied and any unearned premium under $100 is subject to the deductible.  The Department will not require proof of claim forms from policyholders who have a potential return premium claim in the estate of WIC.  Potential claims include the return premium claims of policyholder claimants who had a policy in force on the date of liquidation and all other return premium claims who the department calculates are due return premium.  Policyholders do not need to do anything to file a timely claim for return premium or to have their claim accepted by the Department.

Do I need to submit a proof of claim form to the Department in order to have my invoices for claim related expenses paid?

Yes.  If you have unpaid invoices for services related to specific claim files (IME, copy charges, legal defense fees, damage estimation, appraisers, adjusting etc.) your claim is considered a General Creditor, Class 6 claim. A guaranty association does not usually cover these. There may be insufficient assets to pay these types of claims, however, you must file a proof of claim form to have your claims considered. These types of claims are most often considered Master Claims as they involve more than one invoice.
